    There is something very unsettling about seeing video of police breaking down the front door of a 79-year-old woman’s house. Not because doors need to be opened sometimes or because animal welfare isn’t important, but because the scene makes you wonder: was all of this really necessary?

    The case between Dr. Katherine Theodotou and the RSPCA started in March of this year, when police came to her home in north London with a warrant and what looked like an axe. The reason given was worry for Rita, her 17-month-old black and white cat, after what Dr. Theodotou calls a “malicious report” of abuse. After what happened, there is now a High Court case between the RSPCA and the Metropolitan Police, with accusations that sound like they belong in a much older, darker story.

    It’s not easy to put Dr. Theodotou into a neat category. She was born in Cyprus and used to be a human rights lawyer. She ran an award-winning firm in Islington, started a Greek school in the same area, and now runs an animal sanctuary near Hertford. After being caught lying on an insurance application, she was also taken off the UK solicitors register in 2022. That doesn’t change the fact that she is right or wrong in this case. But it does point to someone who had enough experience to know, maybe better than most, what kind of fight she was in.

    She makes a strong case for Rita’s care. She says that she hired two private nurses and a physiotherapist just to take care of the cat. When it came to court, the RSPCA gave a very different picture. Their lawyer told the judge that Rita was found in a “extremely concerning” state after having a seizure. She had been left for long periods of time without proper hygiene or supervision. It’s not possible for both sides to be right. As it almost always is, the truth is likely to be somewhere between two sure versions of what happened.

    What happened next makes this case harder to ignore. Rita died suddenly and out of the blue while in RSPCA foster care, just two days before the ownership dispute was set to go to magistrates court. Everything changed because of that event. A fight over a cat that was still alive turned into a legal battle over a body, an autopsy, and what really killed the animal.

    In the end, the High Court wouldn’t just give Rita’s body back to Dr. Theodotou. Instead, they ordered a joint post-mortem to be done by an RSPCA vet and an independent specialist of her choice. Mr. Justice Kimblin said that both sides had valid interests under the 2006 Animal Welfare Act, but he did so in a calm way that was very different from the rest of the argument. Given the situation, it was probably the most reasonable thing that could have happened.

    Still, the bigger picture makes me feel uneasy. Assault, battery, trespass, and negligence claims have been made against the Met for assault, Dr. Theodotou has also made claims against the RSPCA. The Metropolitan Police say they legally carried out an entry warrant. As the RSPCA says, it acted because it cared about animals. Technically, both of those statements could be true, but they would still leave open questions about proportionality.

    While watching this case from the outside, it makes me think of something that most people don’t think about: the RSPCA is a private charity, not a government agency, but when it comes to putting axes through people’s front doors, its actions feel very official. We will have to wait for the courts to decide if those powers were used correctly in this case.

    Rita is no longer there. The results of the autopsy are still not in. And Dr. Theodotou, who is 79 years old, is moving forward. No matter what you think of her or the RSPCA’s actions, this dispute—about a disabled cat, a broken door, and a death in foster care—has brought up issues that affect more than just one woman and her pet.
